Acceptance of These Terms

By accessing the Peak Books website, creating an account, or placing an order, you agree to these Terms of Service and the policies referenced within them. If you do not agree with these terms, please do not use the website or place an order.

Online Store

You must provide current, complete, and accurate contact, billing, shipping, and payment information when placing an order. You are responsible for reviewing your order details before completing checkout and for reviewing any changes you make to an order after purchase.

You may not use the website or its products for any unlawful, fraudulent, abusive, or unauthorized purpose.

Products and Availability

Products are subject to availability. We make reasonable efforts to display product descriptions, images, editions, formats, regions, packaging, prices, and availability accurately. Colours and packaging may appear differently depending on the device used, and manufacturers or distributors may change product specifications or packaging without notice.

Customers are responsible for confirming that the title, edition, format, region, and equipment compatibility meet their requirements before ordering.

Orders and Purchase Limits

Peak Books may limit select products to one unit or another stated quantity per customer.

Purchase limits may also apply to high-demand items, limited releases, promotions, or sales.

Purchase limits may apply by customer, household, shipping address, billing address, account, email address, or payment method. The website may allow a higher quantity to be added to the cart, but all orders remain subject to posted purchase limits and manual review.

Orders exceeding or attempting to bypass a purchase limit may be adjusted, partially refunded, or cancelled. This includes duplicate quantities within one order or multiple related orders placed to bypass a limit.

We may also decline or cancel an unfulfilled order because of unavailable inventory, an incorrect price or listing, suspected fraud, payment issues, a purchase-limit violation, or another store-policy violation. If Peak Books cancels a paid, unfulfilled item or order, the applicable amount will be refunded to the original payment method.

Account and Policy Misuse

Peak Books may restrict an account, deny an unsupported claim, cancel an unfulfilled order, or decline future orders when a customer repeatedly violates purchase limits or store policies, or uses returns, damage claims, promotions, Peak Points, or other store programs in a false, misleading, fraudulent, or abusive manner.

These actions will be taken reasonably and subject to applicable law. Any paid amount for an order cancelled by Peak Books before fulfilment will be refunded to the original payment method.

Prices and Payment

All prices are shown in Canadian dollars unless otherwise stated. Applicable taxes, shipping charges, and available payment options are shown during checkout.

Payment for all orders, including pre-orders, is processed at checkout rather than when the order ships. Prices may change at any time because of availability, supplier costs, market conditions, or other adjustments. We do not provide price adjustments or refunds for price differences after an order has been placed.

Pre-Orders

Pre-order items are upcoming releases that are not ready to ship at the time of purchase. Arriving Soon items and Special Orders are separate order types and may have different availability or fulfillment timelines.

Pre-order cancellation requests may be approved before fulfillment and are not guaranteed. If approved, the customer may choose either full store credit or a refund to the original payment method less a 3% processing fee.

Special Orders cannot be cancelled once placed because the item is sourced specifically after purchase.

Orders containing pre-orders are held until every item is available and ready to ship. Customers who want available items sooner should place them as a separate order.

Release dates and distributor timelines are estimates and may change. A listed release date is not a guaranteed Peak Books ship date or delivery date. Pre-orders ship once inventory has arrived at Peak Books and the complete order is available and ready to fulfill. Inventory may arrive before or after the listed release date.

If an item becomes unavailable or cannot be sourced, Peak Books may cancel and refund the affected item or order.

Shipping and Pickup

Shipping, processing, and pickup information is provided in our Shipping Policy. Delivery and arrival estimates are not guaranteed.

Peak Books is not responsible for delays caused by carriers, distributors, customs, weather, manufacturing issues, or other circumstances outside our reasonable control. Nothing in this section limits any rights or remedies provided by applicable law.

Returns, Damage Claims and Cancellations

Returns, damage and defect claims, final-sale items, and cancellation requests are governed by our Return and Refund Policy.

General returns or exchanges are not accepted except where required by applicable law. If a customer-requested cancellation is approved, the customer may choose either full store credit or a refund to the original payment method less a 3% processing fee. Pre-order cancellation requests may be approved before fulfillment. Special Orders cannot be cancelled once placed.

Peak Points, Promotions and Store Credit

Peak Points are promotional loyalty points and are separate from Shopify store credit and gift cards. Peak Points have no cash value and cannot be sold, transferred, or redeemed for cash.

Points connected to a refunded, cancelled, reversed, or fraudulent transaction may be removed. Peak Books may correct points issued in error and may restrict participation where the program is misused.

Promotional offers, discounts, and rewards are subject to any additional conditions displayed with the offer. Discounts and rewards reduce the merchandise total used to determine eligibility for free shipping. Unless expressly stated otherwise, promotions cannot be combined or applied retroactively to previous orders.

Peak Books may modify or discontinue a loyalty program or promotion, subject to applicable law and any notice requirements that apply.

Intellectual Property

Peak Books branding, original text, graphics, website design, and other original content may not be copied, reproduced, distributed, or reused without permission.

Product images, cover artwork, trademarks, logos, and other materials belonging to manufacturers, distributors, studios, publishers, or other rights holders remain the property of their respective owners.

Third-Party Services

Certain store functions may be provided by third parties, including Shopify, payment providers, shipping carriers, analytics services, and other service providers. Your use of those services may also be subject to the provider’s terms and policies.

Peak Books is not responsible for third-party websites or services that are outside our control.

Privacy

Personal information is collected, used, and disclosed according to our Privacy Policy.

Disclaimer and Limitation of Liability

To the fullest extent permitted by applicable law, Peak Books is not liable for indirect, incidental, or consequential loss resulting from use of the website, product incompatibility, or delays and interruptions outside our reasonable control.

Nothing in these terms excludes or limits liability, rights, or remedies that cannot legally be excluded or limited.

Governing Law

These terms are governed by the laws of Alberta and the applicable federal laws of Canada, subject to any mandatory consumer protections that apply in the customer’s province or territory.

Severability

If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Changes to These Terms

We may update these terms from time to time by publishing the revised version on this website. Changes apply prospectively and do not alter the terms governing an order already placed unless required by law or agreed to by the customer.
